CONSUMER TERMS OF SALE
PLEASE READ THESE TERMS OF SALE CAREFULLY BEFORE PLACING YOUR ORDER AND RETAIN A COPY OF THESE TERMS AND YOUR ORDER FOR FUTURE REFERENCE

| 1. Format of the Contract |
| 1.1 |
These terms of sale apply to all goods supplied by PCbuyers.co.uk, whose office is at 9 London Road, Peterborough, PE2 8AN (the "Supplier"). You, the Customer - a person or company buying Products from us (the “Supplier”). |
| 1.2 |
No contract exists between you and the Supplier for the sale of any goods until the Supplier has received and accepted your order and the Supplier has received payment in full (in cleared funds). Once the Supplier does so, there is a binding legal contract between us. |
| 1.3 |
By way of clarification, an acknowledgement of your order will be sent to you via e-mail when you place your order, but acceptance of your offer to buy the goods will not take place until after your payment is taken and you receive your acceptance e-mail. It is at this point that a binding legal contract is created and any contract is subject to these Terms and Conditions. |
| 1.4 |
The contract is subject to your right of cancellation (see below). |
| 1.5 |
The Supplier may change these terms of sale without notice to you in relation to future sales. |

| 2. Description and price of the goods |
| 2.1 |
The description and price of the goods you order will be as shown on the Supplier's website at the time you place your order. |
| 2.2 |
Goods stocked and/or purchased in our online auction centres (such as Ebay etc.) may be priced differently to goods on our website. |
| 2.3 |
All prices are in Pounds Sterling and are liable of VAT |
| 2.4 |
The goods are subject to availability. If on receipt of your order the goods you have ordered are not available in stock, the Supplier will inform you as soon as possible and refund or re-credit you for any sum that has been paid by you or debited from your credit card for the goods. |
| 2.5 |
Every effort is made to ensure that prices shown on the Supplier's website are accurate at the time you place your order. If an error is found, the Supplier will inform you as soon as possible and offer you the option of reconfirming your order at the correct price, or cancelling your order. If the Supplier does not receive an order confirmation within 14 days of informing you of the error, the order will be cancelled automatically. If you cancel, the Supplier will refund or re-credit you for any sum that has been paid by you or debited from your credit card for the goods. |

In addition to the price, you may be required to pay a delivery charge for the goods. |

| 3. Payment |
| 3.1 |
Payment for the goods and delivery charges can be made by any method shown on the Supplier's website at the time you place your order. Payment shall be due before the delivery date and time for payment shall be of the essence.
For all online auctions (such as Ebay etc.) the Supplier has to receive the payment within working 7 days. Otherwise will inform Ebay and will leave negative feedback for you. |
| 3.2 |
There will be no delivery until cleared funds are received. |
| 3.3 |
Payments shall be made by you without any deduction whether by way of set-off, counterclaim, discount, abatement or otherwise unless you have a valid court order requiring an amount equal to such deduction to be paid by the Supplier to you. |

| 4. Delivery |
| 4.1 |
The goods you order will be delivered to the address you give when you place your order, except that some deliveries are not made outside the United Kingdom. |
| 4.2 |
Orders placed before 3:00 pm on a working day will be processed that day and will be delivered within 1-7 working if no additional security checks are required and all stock items are available. (A working day is any day other than weekends and bank or other public holidays.) |
| 4.3 |
If delivery cannot be made to your address for reasons under the Supplier's control the Supplier will inform you as soon as possible and refund or re-credit you for any sum that has been paid by you or debited from your credit card for delivery. |
| 4.4 |
If you deliberately fail to take delivery of the goods (otherwise than by reason of circumstances under control of the Supplier) then without prejudice to any other right or remedy available to the Supplier, the Supplier may: |
| 4.4.1 |
store the goods until actual delivery and charge you for reasonable costs (including insurance) of storage; or |
| 4.4.2 |
sell the goods at the best readily obtainable price and (after deducting all reasonable storage and selling expenses) account to you for any excess over the price you agreed to pay for the goods or charge you for any shortfall below the price you agreed to pay for the goods. |
| 4.5 |
If you fail to take delivery because you have cancelled your contract under the Distance Selling Regulations the Supplier shall refund or re-credit you within 30 days for any sum that has been paid by you or debited from your credit card for the goods, less any expenses incurred for failed delivery. |
| 4.6 |
Every effort will be made to deliver the goods as soon as possible after your order has been accepted. However, the Supplier will not be liable for any loss or damage suffered by you through reasonable or unavoidable delay in delivery. In this case, the Supplier will inform you as soon as possible. |
| 4.7 |
Time for delivery shall not be of the essence. The goods may be delivered by the Supplier in advance of the quoted delivery date. |

| 5. Damages, Loss or Shortages in transit |
| 5.1 |
Any damages (internal or external) to goods in transit, or shortages, must be notified to the carriers immediately and to the Supplier within 48 hours of receipt in writing by post or email. Packaging must be held for inspection at a later date. |
| 5.2 |
On receipt of your goods you will be asked to sign for the goods received in good condition. If you are unable to check the contents of the package at that moment in time please sign for the parcel as “CONTENTS UNCHECKED”. Failure to do so may affect your warranty claims that you make thereafter |

| 6. Risk/Title |
| 6.1 |
The goods are at your risk from the time of delivery |
| 6.2 |
Ownership of the goods shall not pass to you until the Supplier has received in full (in cash or cleared funds) all sums due to it in respect of: |
| 6.2.1 |
the goods, and |
| 6.2.2 |
all other sums which are or which become due to the Supplier from you on any account. |
| 6.3 |
The Supplier shall be entitled to recover payment for the goods notwithstanding that ownership of any of the goods has not passed from the Supplier. |

| 7. Title for Business Customers |
| 7.1 |
If you are a business customer until ownership of the goods has passed to you, you must: |
| 7.1.1 |
store the goods (at no cost to the Supplier) separately from all your other goods and goods of any third party in such a way that they remain readily identifiable as the Supplier's property; |
| 7.1.2 |
not destroy, deface or obscure any identifying mark or packaging on or relating to the goods; maintain the goods in satisfactory condition and keep them insured on the Supplier's behalf for their full price against all risks to the reasonable satisfaction of the Supplier. On request you shall produce the policy of insurance to the Supplier; and condition and keep them insured on the Supplier's behalf for their full price against all risks to the reasonable satisfaction of the Supplier. | 7.1.3 |
hold the proceeds of the insurance referred to in condition 6.1.2 on trust for the Supplier and not mix them with any other money, nor pay the proceeds into an overdrawn bank account. |
| 7.2 |
If you are a business customer your right to possession of the goods shall terminate immediately if: |
| 7.2.1 |
you have a bankruptcy order made against you or make an arrangement or composition with your creditors, or otherwise take the benefit of any statutory provision for the time being in force for the relief of insolvent debtors, or (being a body corporate) convene a meeting of creditors (whether formal or informal), or enter into liquidation (whether voluntary or compulsory) except a solvent voluntary liquidation for the purpose only of reconstruction or amalgamation, or have a receiver and/or manager, administrator or administrative receiver appointed of its undertaking or any part thereof, or a resolution is passed or a petition presented to any court for your winding up or for the granting of an administration order in respect of you, or any proceedings are commenced relating to your insolvency or possible insolvency; or |
| 7.2.2 |
you suffer or allow any execution, whether legal or equitable, to be levied on your property or obtained against you or you are unable to pay your debts within the meaning of section 123 of the Insolvency Act 1986 or you cease to trade; or |
| 7.3 |
you encumber or in any way charge any of the goods. |

| 8. Your right of cancellation (Distance selling regulations) |
| 8.1 |
Under the Distance Selling Regulations the customer has the right to cancel the order for any item purchased and claim a full refund. This right does not apply in the case of software where the seal has been broken or for consumable goods, which, by their nature, cannot be returned. To cancel your order you must notify the Supplier as required in Clause 8.2 within seven working days following the day of delivery. You must return the product to us as required by these Terms but if you do not or if you return the product at our expense we may charge you the reasonable costs of returning a product. |
| 8.2 |
Should you wish to exercise your rights under the Distance Selling Regulations your order may only be cancelled in writing, by post, fax or by e-mail. Telephone cancellations cannot be accepted. |
| 8.3 |
The goods must be returned in an unused and re-saleable condition. You are responsible for the cost of safe carriage back to us. The goods should be packed in its original packaging. It is essential that there is no damage to any part of packaging. Care must be taken when packing the goods for transit. You are advised to arrange for adequate insurance to cover the goods during its return journey. You must take reasonable care to ensure the goods are not damaged in the meantime or in transit. |
| 8.4 |
If the returned goods received by the Supplier are not in a sellable 'as new' condition, then the Supplier reserves the right to charge a restocking fee which will be 20% of the goods value. Whether goods are returned in a sellable condition is to be judged by the Supplier. |
| 8.5 |
The goods should be returned within seven working days from the date we receive your cancellation. If you are unable to return the goods to us within seven working days you must contact us to arrange a collection that will be at your cost. |
| 8.6 |
You may cancel Services in the same way, within seven days of purchase, unless the services begin sooner. The Distance Selling Regulations do not apply to financial and insurance services. The Delivery service is contracted-out to a third party courier and is a separate contract that is deemed to have begun and been completed before the end of the cooling-off period. |
| 8.7 |
Software can only be returned if the seal on the product is completely intact. The Supplier will not refund for any software when the licence has been activated or agreed by the customer. The only exception to this is if the software is faulty or misdescribed. Should this be the case, please contact the Supplier. |
| 8.8 |
Any software that forms a part of the goods (driver and software disks) if unsealed by the customer are exempt from the right to cancel and return the goods under the Distance Selling Regulations. However, if the goods are not as specified, advertised or faulty, then the customer may still reject the goods under The Sales of Goods Act. |
| 8.9 |
Customer Build Systems |
| 8.9.1 |
Customer Build Systems are not covered by the Distance Selling Regulations. This does not include our pre-specified Computer Systems available directly from stock |
| 8.9.2 |
Requests to cancel or reschedule Customer Build Systems orders must be made in writing (by registered post, fax or email) by the customer to the Supplier. The Supplier is under no obligation to accept such cancellations or reschedules. Without prejudice, the Supplier reserves the right to implement a charge on the customer to recover the costs and loss of profit incurred due to such cancellation for whatever reason, (normally a minimum of 20% of the full purchase price) should the Supplier agree to a cancellation. |
| 8.10 |
Once you have notified the Supplier that you are cancelling the contract, the Supplier will refund or re-credit you within 30 days for any sum that has been paid by you or debited from your credit card for the goods. |

| 9.Warranty |
| 9.1 |
The Supplier does not manufacture the goods (or where the goods comprise computer software does not publish the software) and subject to the conditions set out below the Supplier sells the goods with the benefit of the manufacturer’s or publishers’ warranty (as the case may be). |
| 9.2 |
All goods are covered by a 12 month repair warranty for parts and labour only from the date of purchase (unless otherwise stated). This warranty does not affect your statutory rights as a customer. |
| 9.3 |
In the case where the equipment manufacturer offers on site warranty, the customer will be responsible for contacting the manufacturer or its agents directly to obtain the services required. The Supplier will not be held responsible for the failure of the manufacturer or its agents to carry out the necessary repairs. The Supplier will accept liability for defective goods only to the extent that the Supplier is entitled to make a claim under the manufacturer’s or publishers’ warranty and obtain from the manufacturer or publisher a refund, credit or replacement in respect of the defective goods. |
| 9.4 |
The Supplier warrants that the goods will be at the time of delivery correspond to the description given by the Supplier. Except where the customer is dealing as a consumer (as defined in the unfair contract terms act 1977, section 12) all other warranties, conditions or terms relating to fitness for purpose, merchantability or condition of the goods, whether implied by statute common law or otherwise are excluded and the customer warrants that the customer is satisfied as to the suitability of the goods for the customer’s purpose. |
| 9.5 |
The Supplier does not replace any faulty items in advance without first being able to examine the faulty item(s) for themselves. |
| 9.6 |
This warranty does not apply to any defects in the goods arising from fair wear and tear, wilful damage, accident, negligence by the customer or third party, use otherwise than recommended by the Supplier, failure to follow the Supplier’s instructions, or any alteration or repair carried out without the Supplier’s approval. |
| 9.7 |
The Supplier will repair or replace, at its discretion, faulty equipment, it will be the customer’s liability to pay carriage charges for returning goods in any circumstances to the Supplier’s premises |
| 9.8 |
This warranty does not apply to Goods where the warranty label is found to have been tampered with / torn |
| 9.9 |
This warranty does not apply to goods where they are found not to have been sold to the customer by the Supplier. |
| 9.10 |
Any claim that any Goods are not of the correct quantity or do not comply with their description shall be notified by the Customer to the Supplier in 7 days of their delivery. |
| 9.11 |
The supplier reserve the rights to reject any goods, which do not have a corresponding RMA number displayed clearly on the item(s). An RMA number must be obtained before any item is sent back to the Supplier. The procedure for obtaining an RMA number can be found at the 'contact us' Section in the Supplier Web Site. |
| 9.12 |
If the goods supplied to you are damaged on delivery, you should notify the Supplier in writing via e-mail, by post or fax number shown below within 7 days hours. After 7 days, any claims of physical damage or shortage in transit will not be accepted. |

| 10. Compatibility |
| 10.1 |
Goods are not supplied on a trial basis. Customers are responsible for verifying suitability and compatibility of equipment before purchasing it. Customers are encouraged to check with the manufacturer’s websites and current literature for the latest revisions and compatibility of such goods. |
| 10.2 |
All software items supplied are subject to manufacturers licensing agreement. The seal must not be broken if the conditions of the licence are not acceptable. |

| 11. Ownership and Risk |
| 11.1 |
The risk in goods shall pass to the customer when a contract is made but kept at the Supplier’s premises at the customer’s request. |
| 11.2 |
The Supplier remains the owner of the goods affected by the contract until the customer has been paid in full for such goods. |
| 11.3 |
If any payment due under these conditions is overdue in whole or in part, the Supplier may without prejudice to any of its other rights recover and/or re-sell the goods or any of them and may enter the customer’s premises, with his permission hereby confirmed as a condition of contract, by its servants or agents to recover the goods and the customer shall be liable for all the Supplier’s costs of so doing. |
| 11.4 |
If the customer is a consumer and properly rejects any of the goods which are not in accordance with the contract, the customer shall nonetheless pay the full price for such goods unless the customer promptly gives notice of rejection to the Supplier and at the customer’s cost return such goods to the Supplier in good condition. |
| 11.5 |
In the case of any other sale the customer shall inspect the goods immediately upon delivery and shall notify the Supplier within seven days of delivery if the goods are damaged or do not comply with the contract. If the customer fails to do this, he is deemed to have accepted the goods. |

| 12. Limitation of Liability |
| 12.1 |
the Supplier's total liability in contract, tort (including negligence or breach of statutory duty), misrepresentation, restitution or otherwise, arising in connection with the performance or contemplated performance of this agreement shall be limited to the price paid for the goods. |
| 12.2 |
Nothing in these conditions excludes or limits the liability of the Supplier for death or personal injury caused by the Supplier's negligence or fraudulent misrepresentation. |
| 12.3 |
If you are a business customer the Supplier shall not be liable to you for any indirect or consequential loss or damage (whether for loss of profit, loss of business, depletion of goodwill or otherwise), costs, expenses or other claims for consequential compensation whatsoever (howsoever caused) which arise out of or in connection with this agreement. |
| 12.4 |
Where the Supplier supplies driver disks for the purpose of loading drivers for various hardware devices it is the responsibility of the customer to check for any viruses that may be on the disks before they load them to any machine, we cannot be held responsible for any loss of business due to viruses on drivers or any software |

| 13. Data Protection |
| The Supplier will take all reasonable precautions to keep the details of your order and payment secure but unless the Supplier is negligent, the Supplier will not be liable for unauthorised access to information supplied by you. |
|
| |
| 14. Applicable Law |
| These terms of sale and the supply of the goods will be subject to English law and the English courts will have jurisdiction in respect of any dispute arising from the contract. |
